AGREEMENT TO LEGAL TERMS
These Terms of Service ("Terms") constitute a binding legal agreement between Canuck Playhouse ("the Platform", "we", "us", or "our"), a Canadian provider of free-to-play digital entertainment services, and any individual who accesses, uses, or interacts with the Platform ("you" or "the user"). By accessing or using the Platform available at https://canuckplayhouse.com, you confirm that you:
- Are a natural person who is at least eighteen (18) years of age;
- Are accessing the Platform from within Canada and are a lawful resident of Canada;
- Have the legal capacity and authority to enter into binding contractual obligations;
- Have read, understood, and consent to be bound by these Terms and all applicable federal and provincial laws and regulations governing online content, privacy, consumer rights, and advertising standards.
If you do not meet these requirements or do not accept these Terms in full, you must immediately cease all use of the Platform. Your continued access or use of the Platform following publication of any revised Terms shall constitute binding acceptance of such revisions.

1. PROVISION OF SERVICES
The Platform is a browser-accessible digital entertainment environment that offers Canadian users aged eighteen (18) and older access to free, non-monetized, socially enhanced slot-style games and features. All content is provided exclusively for lawful personal entertainment and social interaction. No monetary stakes, prizes, real-value currency exchanges, or financial transactions of any kind are facilitated, simulated, or implied by the Platform. All features operate within a purely recreational framework.
Use of the Platform is strictly limited to non-commercial purposes. Users may not resell, redistribute, or exploit Platform content or mechanics for any revenue-generating activity. The Platform may feature limited social engagement mechanics, leaderboards, and virtual rewards, but does not include account-based wagering systems, multiplayer competition for material gain, or persistent user data tracking outside of the scope disclosed in our Privacy Policy.
We may display third-party advertising in accordance with applicable Canadian legislation including the Competition Act, Canada's Anti-Spam Legislation (CASL), and ad platform policies (including Google Ads and Microsoft Advertising). All advertising content is for informational purposes only. We do not endorse, review, or guarantee the accuracy or legality of any third-party offering or content accessed through external links. It is your sole responsibility to ensure compliance with all applicable legal obligations when accessing the Platform or interacting with third-party services.
2. INTELLECTUAL PROPERTY RIGHTS
All proprietary rights, title, and interest in and to the Platform, including all games, software, source code, audio-visual content, visual elements, user interface components, design architecture, trademarks, logos, and related materials ("Platform Content") are owned by or validly licensed to Canuck Playhouse and are protected by applicable Canadian intellectual property laws and international conventions.
No ownership or licence in any trademark, service mark, logo, or branding element ("Marks") is transferred to users by virtue of access. All Marks are either proprietary to Canuck Playhouse or lawfully used under licence. Users shall not use, reproduce, modify, obscure, or exploit any such Marks without prior written authorisation.
Subject to these Terms, you are granted a non-exclusive, non-transferable, revocable, limited licence to access and display Platform Content solely for personal, lawful, non-commercial use. This licence does not authorise:
(a) copying, reproducing, redistributing, or republishing any Platform Content;
(b) modifying, reverse-engineering, translating, or creating derivative works;
(c) using any part of the Platform to develop or support a competing service;
(d) deep-linking, framing, or embedding Platform Content on external sites;
(e) conducting data scraping, crawling, or systematic content extraction.
Any breach of this licence shall constitute a material violation and may result in immediate suspension or termination of access, and potential legal recourse.
Where Platform features incorporate third-party intellectual property under licence, all such content remains the exclusive property of the respective owner. Nothing in these Terms shall be interpreted to transfer or assign any rights in such third-party content. All rights not expressly granted herein are reserved.
3. USER ELIGIBILITY AND DECLARATIONS
By using the Platform, you represent and warrant that:
(a) You are a natural person who is at least eighteen (18) years of age;
(b) You are a lawful resident of Canada and are accessing the Platform from within Canadian territory;
(c) You possess the full legal capacity to enter into binding agreements;
(d) You will use the Platform solely for lawful, private purposes consistent with these Terms;
(e) You will not use bots, scripts, crawlers, or other automated mechanisms to access, interact with, or manipulate Platform systems or content;
(f) You will comply with all applicable Canadian federal, provincial, territorial, and municipal laws and regulations in relation to your use of the Platform.
Canuck Playhouse reserves the right to monitor and audit usage for compliance purposes. Any misrepresentation or breach of this clause may result in denial or revocation of access, suspension of functionality, or reporting to relevant authorities.
4. RESTRICTED CONDUCT
You shall not engage in, permit, or facilitate any of the following prohibited behaviours, whether directly or indirectly:
(a) Deploying automated scripts, bots, spiders, or systems to access or replicate Platform data;
(b) Disrupting Platform functionality or performance through denial-of-service attacks, interference, or infrastructural tampering;
(c) Transmitting malware, ransomware, spyware, or other malicious code;
(d) Attempting unauthorised access to Platform databases, codebases, infrastructure, or protected content;
(e) Falsifying user identity, affiliation, or intent;
(f) Infringing upon third-party intellectual property, privacy, moral rights, or proprietary interests;
(g) Using the Platform as a conduit for unsolicited messaging, spam, or advertising;
(h) Linking to or promoting gambling, cryptocurrency speculation, real-money games of chance, or financial trading platforms;
(i) Collecting or harvesting user activity data, behavioural metrics, or engagement signals for commercial or profiling purposes;
(j) Circumventing access restrictions, age-verification tools, or consent mechanisms;
(k) Engaging in conduct that violates applicable advertising or consumer protection legislation or platform compliance standards.
Violation of this clause constitutes a material breach of these Terms and shall entitle Canuck Playhouse to pursue all available civil and regulatory remedies, including suspension, permanent access revocation, or legal proceedings.
5. USER SUBMISSIONS
5.1 The Platform does not include user-generated content features, public comment sections, multiplayer chat, or publishing functions. You are not permitted to upload, transmit, or post any content unless you have received prior written authorisation from Canuck Playhouse.
5.2 Where you voluntarily submit feedback, ideas, technical suggestions, bug reports, or any form of communication to us, whether by email or through contact forms ("Submissions"), you confirm that:
(a) You possess full legal rights in and to the Submission;
(b) The Submission is not confidential, proprietary, or subject to any third-party obligations;
(c) The Submission is lawful, non-infringing, and free from defamatory or prohibited content;
(d) You provide the Submission with no expectation of compensation, confidentiality, or attribution.
5.3 We may, at our sole discretion:
(a) Use, modify, incorporate, or disregard any Submission;
(b) Store, delete, or archive Submissions without obligation to notify or respond.
You waive any claims arising from our use or non-use of Submissions submitted to the Platform.
6. LICENCE TO CONTRIBUTIONS
6.1 Where you provide Canuck Playhouse with any feedback, concepts, creative material, gameplay suggestions, technical improvements, or related content ("Contributions"), you grant us an irrevocable, royalty-free, sublicensable, assignable, worldwide licence to:
(a) Reproduce, display, distribute, adapt, modify, or incorporate the Contribution in any form;
(b) Use the Contribution in connection with the Platform, marketing materials, documentation, or business operations.
6.2 You waive all moral rights in respect of any such Contributions and confirm that:
(a) You are not entitled to financial compensation, acknowledgement, or future attribution;
(b) We may exploit the Contribution without restriction or prior notice;
(c) You bear full legal responsibility for the legality and originality of the Contribution.
6.3 You agree to indemnify Canuck Playhouse against all liabilities, damages, claims, and expenses (including legal fees) arising from any third-party allegation that your Contribution infringes intellectual property or violates applicable law.
7. PLATFORM GOVERNANCE AND ENFORCEMENT
7.1 To ensure security, compliance, and operational continuity, Canuck Playhouse reserves full authority to:
(a) Monitor Platform activity for misuse, technical anomalies, or breach of Terms;
(b) Temporarily or permanently suspend access for any user or device suspected of non-compliance;
(c) Disable or delete Submissions, Contributions, or communication deemed unlawful or harmful;
(d) Cooperate with federal, provincial, or municipal authorities in response to valid legal requests or investigations;
(e) Implement geo-fencing, access throttling, IP blocking, or rate-limiting measures to mitigate abuse.
7.2 The Platform may be unavailable from time to time due to maintenance, software upgrades, third-party outages, regulatory obligations, or security updates. We do not guarantee continuous availability or uninterrupted access.
7.3 You acknowledge that any interference with Platform integrity, including attempts to circumvent technical restrictions or simulate unauthorised functionality, may result in legal action and notification to law enforcement.
8. DURATION AND TERMINATION
8.1 These Terms remain in effect from the moment you first access the Platform and shall continue until terminated by either party.
8.2 We may, in our sole discretion and without prior notice:
(a) Suspend or revoke your right to access the Platform;
(b) Remove or delete any Submission or Contribution received from you;
(c) Restrict or disable access to specific features, services, or advertising components;
(d) Initiate legal action where we believe you have breached these Terms, violated Canadian law, or caused harm to the Platform, users, or public interest.
8.3 You may cease using the Platform at any time. Cessation of use shall not affect any rights, obligations, or liabilities that accrued prior to termination.
8.4 Clauses intended to survive termination, including those relating to intellectual property, indemnity, liability, and dispute resolution, shall remain in force following the end of your access to the Platform.
9. AMENDMENTS, MODIFICATIONS, AND INTERRUPTIONS
9.1 Canuck Playhouse reserves the right to modify, suspend, or discontinue any aspect of the Platform, including features, games, content, or technical infrastructure, at any time and without liability.
9.2 We may amend these Terms at our sole discretion by publishing an updated version at https://canuckplayhouse.com. Amendments become legally binding upon publication unless otherwise specified.
9.3 Continued use of the Platform following any such amendments constitutes your conclusive acceptance of the revised Terms. You are solely responsible for reviewing the Terms periodically to remain informed.
9.4 We shall not be liable for any loss, harm, or inconvenience arising from:
(a) Platform maintenance, unavailability, or technical outages;
(b) Modification, suspension, or discontinuation of Platform services or features;
(c) Force majeure or events beyond our reasonable control, including network failure or regulatory intervention;
(d) Revocation or restriction of access under these Terms.
10. GOVERNING LAW AND JURISDICTION
10.1 These Terms are governed exclusively by the laws of the Province of Ontario and the federal laws of Canada applicable therein, excluding any conflict of laws principles.
10.2 You irrevocably submit to the exclusive jurisdiction of the courts located in Ottawa, Ontario for the resolution of any dispute, claim, or proceeding arising from these Terms or your use of the Platform.
10.3 You are solely responsible for ensuring that your access and use of the Platform complies with all applicable local, provincial, and federal laws. Access from any jurisdiction where the Platform or its use would be unlawful is strictly prohibited.
11. DISPUTE RESOLUTION PROCEDURES
11.1 Before initiating any formal legal proceeding, the parties shall first make reasonable efforts to resolve any dispute or controversy ("Dispute") informally and in good faith.
11.2 A party may initiate informal resolution by providing written notice describing the nature of the Dispute. The parties shall cooperate for a period of no less than thirty (30) calendar days to resolve the matter.
11.3 If the Dispute remains unresolved after the informal period, either party may pursue legal remedies in accordance with Clause 10.
11.4 You agree that any Dispute shall be resolved solely on an individual basis, and you waive any right to commence or participate in any class action, collective, or representative proceeding.
11.5 Nothing in this clause shall limit either party's right to seek interim, urgent, or equitable relief before a court of competent jurisdiction where necessary to prevent imminent and irreparable harm.
12. ACCURACY AND CORRECTIONS
12.1 While Canuck Playhouse endeavours to ensure that all Platform content is accurate, complete, and current, we do not guarantee the absence of errors, omissions, or outdated information.
12.2 We reserve the right to correct errors, revise materials, and update Platform content without notice, and we disclaim all liability arising from reliance on outdated or inaccurate information.
12.3 You acknowledge that the Platform is provided for entertainment purposes and that your reliance on any Platform material is entirely at your own risk. We accept no liability for actions taken or decisions made based on Platform content.
13. DISCLAIMER OF WARRANTIES
13.1 The Platform, including all games, features, and services, is provided strictly on an "as is" and "as available" basis. Canuck Playhouse makes no express or implied warranties, conditions, or representations of any kind, including but not limited to:
(a) Merchantability or fitness for a particular purpose;
(b) Accuracy, reliability, or completeness of Platform content;
(c) Availability, compatibility, or uninterrupted performance;
(d) Non-infringement of third-party rights.
13.2 We do not warrant that:
(a) The Platform will operate without interruption, delay, or technical error;
(b) Platform content will be free of malware, bugs, or inaccuracies;
(c) Your experience will meet expectations, function across all devices, or remain consistent over time;
(d) Security mechanisms will be entirely immune to unauthorised access, breaches, or tampering.
13.3 You are solely responsible for:
(a) Internet connectivity, browser configuration, and device security;
(b) Antivirus, firewall, and parental control tools;
(c) Any costs, data usage, or consequences arising from Platform use.
13.4 No information or statement by Canuck Playhouse or its representatives, whether oral or written, shall create any warranty not expressly stated in these Terms.
14. LIMITATION OF LIABILITY
14.1 To the fullest extent permitted by law, Canuck Playhouse, its directors, employees, licensors, and service providers shall not be liable for any indirect, incidental, punitive, exemplary, or consequential damages arising out of or related to your use of the Platform, including but not limited to:
(a) Loss of revenue, profits, opportunity, or business interruption;
(b) Data loss, corruption, or system damage;
(c) Errors, omissions, or technical malfunctions;
(d) Third-party content, advertisements, or external websites;
(e) Suspension or termination of access.
14.2 Canuck Playhouse's cumulative liability for all claims, regardless of legal theory, shall not exceed the greater of:
(a) One hundred Canadian dollars (CAD $100); or
(b) The amount, if any, paid directly by you to Canuck Playhouse in the six (6) months preceding the event giving rise to the claim.
14.3 Nothing in these Terms shall exclude, restrict, or modify any right or remedy that cannot be excluded under applicable Canadian law, including rights under the Competition Act, Consumer Protection Act (Ontario), and other consumer protection legislation.
15. INDEMNITY AND LIABILITY ALLOCATION
15.1 You agree to indemnify and hold harmless Canuck Playhouse, its affiliates, directors, officers, contractors, and licensors from and against any and all claims, damages, liabilities, costs, and expenses (including legal fees) arising from:
(a) Your use or misuse of the Platform;
(b) Your breach of these Terms or any applicable law;
(c) Any Submission or Contribution you provide;
(d) Any third-party claim that your actions caused harm or violated rights;
(e) Fraud, negligence, or willful misconduct on your part.
15.2 We reserve the right, at our sole discretion, to assume the exclusive defence of any matter subject to indemnification. You agree to cooperate in good faith with any such defence.
16. DATA USE AND PROTECTION
16.1 We collect limited technical data (such as browser type, IP address, and usage behaviour) for lawful operational purposes including Platform security, analytics, and performance optimisation. We do not require account registration or collect identifiable user data without your consent.
16.2 All data handling is governed by the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial laws, including:
- Freedom of Information and Protection of Privacy Act (FIPPA – Ontario)
- Consumer Protection Act (Quebec)
- Any successor legislation, regulations, or binding guidance.
16.3 A fully integrated Cookie Consent Management Platform is used to manage opt-in and opt-out preferences for non-essential cookies. You may adjust browser settings or withdraw consent at any time.
16.4 Any personal information voluntarily submitted (e.g., via email or contact form) will be used solely for the purposes specified in our Privacy Policy, which is incorporated by reference into these Terms.
16.5 You remain responsible for managing your own digital privacy settings, including device-level permissions and third-party blocking tools.
17. ELECTRONIC COMMUNICATIONS AND EXECUTION
17.1 By accessing or using the Platform, or by communicating with Canuck Playhouse electronically, you consent to receive all notices, disclosures, agreements, and other communications from us in electronic form. Such communications satisfy any legal requirement for written documentation.
17.2 Electronic communications shall be deemed received on the date of transmission to the contact details you provide or the date of publication on the Platform.
17.3 Acceptance of these Terms, including by means of Platform access or continued use, constitutes your legally binding electronic signature for all purposes under Canadian law, including the Electronic Commerce Act (Ontario) and equivalent provincial statutes.
17.4 If you withdraw your consent to receive communications electronically, you must contact support@canuckplayhouse.com. Withdrawal may result in restriction or termination of your access to the Platform or services.
18. GENERAL PROVISIONS
18.1 Entire Agreement
These Terms, together with the Privacy Policy and any other legally binding notices published on the Platform, constitute the entire agreement between you and Canuck Playhouse and supersede all prior communications and understandings relating to the subject matter herein.
18.2 No Waiver
Failure by Canuck Playhouse to enforce any term or condition shall not constitute a waiver of such provision or of the right to enforce it subsequently.
18.3 Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, the remainder shall remain in full force and effect.
18.4 Assignment
You may not assign, delegate, or transfer any rights or obligations under these Terms without prior written consent. Canuck Playhouse may assign its rights and obligations under these Terms without notice or restriction.
18.5 Independent Relationship
Nothing in these Terms creates a partnership, agency, employment, or joint venture between the parties. Neither party shall hold itself out as having authority to bind the other.
18.6 Survival
Any provisions of these Terms that, by their nature, should survive termination shall remain in effect, including but not limited to those relating to intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution.
19. THIRD-PARTY ADVERTISING AND EXTERNAL LINKS
19.1 The Platform may display third-party advertising, sponsored content, or embedded hyperlinks directing you to websites or services not operated or controlled by Canuck Playhouse.
19.2 Canuck Playhouse makes no representations or warranties regarding third-party products, services, or content, and does not assume responsibility for any interaction or transaction you undertake with such parties.
19.3 You access third-party websites and content entirely at your own risk, subject to the terms and privacy policies of those third parties. Canuck Playhouse expressly disclaims liability for any damages arising from such use.
20. AMENDMENTS TO THESE TERMS
20.1 Canuck Playhouse reserves the right to revise, update, or otherwise modify these Terms at any time to reflect changes in law, operational practices, or Platform functionality.
20.2 Material changes shall be notified via:
(a) An updated "Last Updated" date posted at the top of these Terms; and
(b) Prominent notice via the Platform interface or landing page.
20.3 Continued access or use of the Platform following the posting of any amended Terms constitutes legally binding acceptance of the revised Terms. Users are advised to review the Terms periodically to remain informed of their obligations.
